Effective October 1, 2023, USCIS announced that it will waive the $85 biometrics services fee for all Form I-539 applicants. Applications postmarked on or after October 1 will no longer be required to pay this fee. However, applicants who submit Form I-539 before October 1 may still have to attend a biometric services appointment, if scheduled. After October 1, most applicants will not be scheduled for biometric appointments, unless required by USCIS. 

If the applicant mistakenly pays the biometrics separately from the Form I-539 fee, USCIS will refund the biometric fee and process the I-539 application. However, if the fees are combined into one check, the application will be rejected. This exemption applies to all applicants filing on or after October 1.
